1. Acceptance of Terms

By accessing or using the AssetMindr platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and AssetMindr. Your continued use of the Service following any updates to these Terms constitutes your acceptance of the revised Terms.

2. Description of Service

AssetMindr is a cloud-based data analytics platform designed to complement your existing property management software. The Service displays a summarized snapshot of key performance indicators (KPIs) sourced from third-party property management software systems.

AssetMindr is designed to work alongside your property management software — it does not replace it. The Service provides analytical and reporting capabilities only, and does not perform any property management, leasing, or financial functions directly.

3. Data Accuracy and Limitations

The quality and accuracy of information displayed within AssetMindr are solely dependent on the quality of the information stored in your property management software. AssetMindr does not independently verify, audit, or validate the accuracy of data sourced from third-party systems.

You acknowledge and agree that:

• AssetMindr displays data as received from your property management software without modification.
• Discrepancies, errors, or omissions in your source PMS data will be reflected in the AssetMindr dashboard.
• For critical decisions, you should verify data directly within your source property management software.
• AssetMindr captures daily snapshots and does not retroactively update historical records when changes are made in the source system after a snapshot has been taken.

4. Real-Time Data Notice

Information displayed on the AssetMindr platform is not updated in real time. The Service fetches data from your property management software multiple times throughout the day, approximately every few hours. As a result, there may be a short delay between changes made in your source system and their reflection in AssetMindr.

A "Last Data Collection" timestamp is displayed within the platform to indicate when data was most recently retrieved. You should reference this timestamp to understand the currency of the information you are viewing.

5. No Professional Advice

The information and KPIs provided through the AssetMindr platform are for informational and analytical purposes only. Nothing in the Service constitutes asset management, investment, financial, legal, or professional advice of any kind.

You should not rely solely on data or insights from AssetMindr when making operational, investment, or financial decisions. We strongly recommend consulting qualified professionals before taking action based on information obtained through the Service.

6. Limitation of Liability

To the fullest extent permitted by applicable law, AssetMindr and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

This includes, without limitation, damages arising from:

• Errors, inaccuracies, or omissions in data displayed by the platform
• Failures or outages of third-party property management software systems
• Decisions made by you or any third party based on information obtained through the Service
• Unauthorized access to or alteration of your data
• Any interruption, suspension, or termination of the Service

AssetMindr's total liability for any claims related to the Service shall not exceed the amount paid by you for the Service in the three (3) months preceding the claim.

7. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating an account
• Use the Service only for lawful purposes and in accordance with these Terms
• Not share your account credentials with unauthorized parties
• Notify AssetMindr promptly of any unauthorized use of your account
• Not attempt to reverse engineer, decompile, or otherwise gain unauthorized access to the platform's underlying technology

8. Intellectual Property

All content, technology, software, design, and materials comprising the AssetMindr platform are the exclusive property of AssetMindr and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes only.

You retain ownership of all data you input into or connect to the Service. By using the Service, you grant AssetMindr a limited license to access and process your data solely for the purpose of providing the Service to you.

9. Termination

AssetMindr reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to AssetMindr, other users, or third parties.

You may terminate your use of the Service at any time by contacting us. Upon termination, your right to access the Service will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas.

11. Changes to These Terms

AssetMindr reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
